Some lenders ignoring the protocol of repossession
The Citizens Advice has reported that some lenders are choosing to ignore protocol associated with repossession. They released a report which was based on hundreds of cases in which advisors when to court with property owners and gave them last minute advice. In over a third of the cases, it was shown that the lender failed to adhere to the rules regarding taking repossession proceedings only as the very last resort. Lenders are supposed to offer those faced with mortgage arrears other ways to catch up on the arrears and start court proceedings to repossess only if all else fails. Subprime mortgage lenders were often found to be the worst at taking homeowners to court for repossession.
If you are faced with the possibility of losing your home after falling into mortgage arrears you may wish to choose to sell your home with the option of being able to buy and rent back in the future. Companies typically pay the homeowner less than the full value of their home and in return for this they are able to remain in the property by paying rent. If I was faced with imminent repossession by my lender I could apply to sell my house and rent it back online and in 24 hours if this was a viable option.
